Best&Less “Only The Best FLOWERS for Mum” Full Terms and Conditions
1. This “Only The Best FLOWERS for Mum” (“Competition”) is promoted by Best&Less Pty Limited (ABN 29 003 724 696) (“Best&Less”). Participation in this Competition is deemed acceptance of these Terms and Conditions.
2.Eligibility – To be eligible to participate you enter the competition via the form. You must be an Australian resident aged 18 years or older and you must not be an employee, contractor, agent or otherwise affiliated with Best&Less or connected to the Competition in any way. Entry into the competition is free (however Best&Less is not liable for any costs incurred by you in entering this Competition).
3. How to enter: Online at https://m.cmpgn.page/fJP3W. - Participants must enter their details into the competition form.
4.Key dates - The opening date for the Competition is Tuesday 22nd April 2025 9:00 AEST and the closing date is Friday 9th May 2025 12:00AM AEST. All entries must be received by Best&Less within the Competition Period and Best&Less will not be responsible for any late, lost or misdirected entries.
5.Prize – There will be eight (8) prizes to be won during the Competition. The Prize will consist of twelve (12) bouquets of flowers delivered once every month for twelve (12) months valued at $85 each month ($1020 over the year) for NSW, VIC, SA, QLD, WA, ACT and TAS winners, $100 each month ($1200 over the year) for NT winner. Prize(s) cannot be transferred, exchanged or redeemed for cash.
6.Winner selection – The Competition is a game of chance. Skill plays no part in determining the winner. The draw will take place on Monday 12th May 2025 10:00AM AEST at Level 4, 3 Rider Boulevard, Rhodes NSW 2138 and will be drawn from all entries received during the Competition Period. The Winner will be notified by email and/or phone by Monday 12th May 2025 2:00PM AEST. The Winners will be published on our website and social media on Monday 12th May 2025. The prize must be claimed by Thursday 15th May 2025 12:00PM AEST If the prize is not claimed by this date, an unclaimed prize draw will be carried out on Thursday 15th May 2025 2:00PM AEST. If any person first chosen as a Winner is found to be ineligible, they will be disqualified and another entrant will be selected as a replacement winner.
7.Costs and expenses – You will be responsible for all costs in relation to entering the Competition and redeeming the Prize. The Winner is advised that tax implications may arise from the Prize and independent financial advice should be obtained prior to acceptance of the Prize.
8.Modification of terms – Subject to statutory restrictions, Best&Less reserves the right to modify, discontinue or extend this Competition at any time and will take reasonable steps to notify entrants of changes where practical. The Prize is non-refundable, non-transferable and subject to availability. However, Best&Less reserves the right to substitute the Prize with another Prize of equal value in the unlikely event beyond its reasonable control that the Prize becomes unavailable. If you are not able to take the Prize as stated, you will forfeit the Prize and no payment or compensation will be made in lieu.
9.Privacy – Any personal information you give us will be used solely for this Competition and will not be passed on to any other parties without your agreement and will be otherwise be handled in accordance with the Best&Less privacy policy which can be found at www.bestandless.com.au/privacypolicy. Personal information submitted for this competition will be used by Best&Less for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant and by submitting an entry, the entrant expressly consents to this.
10.Disqualification – Best&Less reserves the right to verify the validity of entries and identity of entrants and to disqualify any entrant if it has reason to believe the entrant has breached the Terms and Conditions, tampers with the entry process, infringes a third party’s intellectual property or engages in misleading or fraudulent behaviour.
11.Legal – You enter the Competition at your own risk. Best&Less will not be responsible for any loss, damages, costs or expenses arising from or in any way connected with any personal injury, loss or damage, errors, defects interruptions, malfunctions or delays connected to or as a result of entry into the Competition (except in the case of negligence or error on the part of Best&Less, any breach of any express term of these Terms and Conditions by Best&Less or any liability which cannot be excluded by law including as provided for under the Australian Consumer Law). Once the Prize has left the premises of Best&Less, Best&Less will not be responsible for any damage, delay or loss to the Prize during transit.
12.Jurisdiction - Any dispute relating to this Competition shall be governed by the laws of New South Wales. Each party submits to the non-exclusive jurisdiction of the New South Wales courts.
13.Australian Consumer Law – Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protections laws in Australia.
